Understanding How and Why Parenting Time Restrictions Are Used in Illinois

Posted on November 23, 2022 in Visitation

Naperville family law attorneyParenting time restrictions limit or restrict the amount or type of parenting time allotted to a parent. These restrictions can be used for a variety of reasons, such as protecting the best interests of children or ensuring that parents are engaging in positive co-parenting practices.

In Illinois, parenting time restrictions are used to protect the safety and well-being of children who live in divided households. If there is evidence that a parent has acted in a way that is or could be detrimental to the child's emotional, physical, or psychological well-being, then parenting time restrictions may be put in place. If there is evidence of domestic violence between the parties, parenting time restrictions can help ensure that the children are not exposed to further harm or distress.

Parenting Time Restrictions in Illinois

Illinois courts generally assume that it is in the best interests of children to have meaningful relationships with both parents. However, if one parent has displayed a pattern of behavior that may negatively impact the child, parenting time restrictions can be implemented. These restrictions can include:

  • Supervised visitation - Supervised visitation requires a responsible adult other than the parent to be present during visitations. The supervisor may be a family member such as a grandparent or a court-appointed professional.
  • Reduced parenting time - The amount of parenting time that a parent is allotted may be reduced.
  • Mandated counseling or substance abuse treatment - The court may require a parent to attend mental health treatment such as counseling if he or she has psychological issues that could affect their parenting. The court may also require a parent to attend substance abuse treatment if there is evidence of drug or alcohol use that could impact the child's safety.
  • Conditions on parenting time - The court may impose restrictions such as prohibiting parents from bringing certain people around the children or prohibiting parents from engaging in activities such as drinking alcohol during visitations.

When parenting time restrictions are imposed, it is important to understand that these restrictions are meant to protect the safety and well-being of the child. It is also important to remember that parenting time restrictions can be modified if circumstances change or if the parents demonstrate that they are engaging in healthy parenting practices. In cases where parenting time restrictions have been imposed, it is best to consult an attorney to discuss available options and ensure that the children's needs are met.
